Admissability Of Reports Under K.s.a. 23-3210.

Schoenig, affirmed). “Investigations and reports ordered under K.S.A. 23-3210 may include psychological evaluations of parents conducted for the purpose of determining appropriate legal custody, residency, visitation rights, and parenting time.  Such investigations and reports are not subject to the requirements of K.S.A. 60-456 (testimony in the form of opinions or inferences) and a Daubert hearing is not required to determine their admissibility.  See Daubert v. Merrell Dow Pharmaceuticals, Inc., 509 U.S. 579, 113 S. Ct. 2786, 125 L.Ed. 2d 469 (1993).”
